These Terms of Service (“Terms”) are an agreement between you and Orlikon, LLC, a United States company (“we”, “us”, “our”). They govern your use of the AutoApply Chrome extension, the website at https://hirefill-web.vercel.app and the AutoApply Pro subscription (together, the “Service”). By installing or using the Service you agree to these Terms; if you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data.
If you are a consumer, nothing in these Terms limits the rights you have under mandatory consumer-protection law in your country of residence.
2. What AutoApply is — and isn’t
AutoApply helps you fill out job application forms on websites using a profile you create, and — if you turn AI on — drafts answers, cover letters and analyses. It fills fields and attaches files in your browser. It does not submit applications. You decide what is submitted, when and to whom.
AutoApply is a software tool. It is not a recruiter, employment agency or careers, legal, immigration or financial adviser, and it does not guarantee interviews, job offers or any other outcome.
3. Eligibility
You must be at least 16 years old to use the Service. To buy AutoApply Pro you must be old enough to enter into a binding contract in your country (or have permission from a parent or guardian). The Service is meant for your own job search. If you use it to help someone else — for example as a careers coach — you must have that person’s authorisation and you remain responsible for what is submitted.
4. Your account
An account is required only for AutoApply Pro. You sign in with your Google account. Keep access to your email and Google account secure; you are responsible for activity under your account. Accounts are personal — one person per account. Tell us promptly at omerdogan0@gmail.com if you suspect unauthorised use.
5. Your responsibilities when applying
You review every application. Before submitting, check every field AutoApply filled, every option it selected, every file it attached and every AI-drafted answer. You are solely responsible for the accuracy, truthfulness and completeness of every application you submit.
Be truthful. Do not misrepresent your identity, qualifications, experience, work authorisation or any other fact. Some forms contain declarations, consent checkboxes or legal attestations; AutoApply may fill them based on your profile, but you must read and confirm each one yourself.
Follow each site’s rules. You must comply with the terms of use of every job site, employer website and applicant-tracking system you use. Some sites restrict automated tools or browser extensions; it is your responsibility to check and to not use AutoApply where it is not allowed.
Keep your own records of what you submit. AutoApply’s tracker is a convenience, not an official record.
6. Acceptable use
AutoApply is designed for one application at a time, under your active review. You must not:
use AutoApply to send automated, bulk or mass applications, or to apply indiscriminately in a way that burdens employers or job sites;
drive AutoApply with bots, scripts, macros or other automation, or use it to submit forms that no human has reviewed;
apply on behalf of another person without their authorisation, or impersonate anyone;
submit false, misleading, plagiarised or unlawful content, or content that infringes anyone else’s rights;
use AutoApply to scrape or harvest data from websites, or to bypass CAPTCHAs, rate limits, access controls or other protections of any website;
access our servers other than through the official extension; reverse engineer, decompile or interfere with the Service or its API (except where the law expressly permits it); or probe, scan or breach its security;
circumvent AI credit limits, create multiple accounts to obtain extra trial credits, share or resell your account, or provide Pro features to others;
generate content that is unlawful, harassing or discriminatory, or that violates the usage policies of the provider currently configured for Pro (currently Anthropic) or of your own AI provider (for BYOK);
use the Service in breach of applicable law, including employment, anti-discrimination, export-control and sanctions laws.
7. AI features and output
AI features are optional. AI output is generated automatically from your profile, the form and the job posting. It can be inaccurate, incomplete, out of date or generic, and it can state things about you that are not true.
You must review, edit and verify AI output before you use it. Never claim experience, skills or qualifications you do not have.
Job-fit scores, match scores and job recommendations are estimates for your convenience. They are not professional careers, legal, immigration or financial advice. We do not guarantee that information in job postings is accurate or that a position is still open.
Some employers set rules on using AI in applications. Follow them.
As between you and us, the AI output generated for you is yours to use for your applications, to the extent the law allows it to be owned. Similar output may be generated for other users.
Job postings shown in job matches come from third-party sources. We do not endorse or vet employers.
8. Your own API key (BYOK)
You may connect your own OpenAI, Anthropic or Google Gemini API key (or an OpenAI-compatible endpoint). Requests then go directly from your browser to that provider, and your use of it is governed by your own agreement with that provider, including its usage policies and fees. You are responsible for all charges your key incurs and for keeping it secure; revoke it with the provider if you think it has been exposed. We never receive your key and are not responsible for the provider’s availability, changes or charges.
9. AutoApply Pro subscription
Billing. Pro is a paid subscription billed in advance, monthly or yearly, through our payment processor Stripe, at the price shown at checkout. Depending on your location, prices may include or exclude taxes; the total is shown before you pay.
Automatic renewal. Your subscription renews automatically at the end of each billing period at the then-current price until you cancel. You authorise Stripe to charge your payment method for each renewal.
AI credits. Pro includes a monthly allowance of AI credits. Different AI actions use different amounts of credits, and your balance is shown in the extension. Unused credits do not roll over and have no cash value.
Price changes. We will give at least 30 calendar days’ notice on this website before a price change applies to your subscription. If you do not agree, you can cancel before the new price takes effect.
Failed payments. If a payment fails, Stripe may retry it, and we may pause Pro features until payment succeeds.
10. Cancellation and refunds
Cancel anytime in AutoApply settings → AI & plan → Manage billing, which opens the Stripe customer portal. Cancelling stops future renewals; Pro stays active until the end of the period you have paid for.
Refunds. Payments are non-refundable, including for partially used billing periods and unused AI credits, except where a refund is required by applicable law (for example, a statutory right of withdrawal for consumers in your country). Cancelling stops future renewals; you keep Pro until the end of the period you paid for.
Statutory rights. This section is in addition to, and does not limit, any statutory rights you have as a consumer under EU, UK, Turkish or other applicable law, including any right of withdrawal. To request a refund or exercise a withdrawal right, email us from the address registered with your account at omerdogan0@gmail.com.
Deleting your account cancels your subscription and ends Pro access immediately. Remaining time is not refunded unless a refund applies under this section or by law.
If you have a billing problem, please contact us before opening a chargeback — we can usually resolve it faster.
11. Trial credits and fair use
New accounts may receive a one-time allowance of free AI credits after signing in. Trial credits are limited to one per person, have no cash value and may be changed or withdrawn for new accounts at any time. To keep the Service reliable for everyone, we may apply reasonable rate limits and revoke credits obtained through abuse.
Eligible first-time monthly subscribers may start a 7-day AutoApply Pro trial through Stripe Checkout. A payment card is required. The monthly price shown before checkout is charged after the trial unless you cancel beforehand through Manage billing. A previous subscription makes the account ineligible for another trial. Annual plans do not include this trial. Opening checkout or signing in alone does not activate Pro; the subscription must be confirmed. Trial use is subject to the displayed AI credit allowance.
12. Third-party sites and services
AutoApply works on websites run by others — employers, applicant-tracking systems and job boards — and relies on third-party services such as Stripe, Anthropic, OpenAI, Supabase and Google. We are not affiliated with or endorsed by any of them, and their names and trademarks belong to their owners. We are not responsible for their content, availability, terms or how they handle your applications and data. Websites change their forms without notice, so autofill may stop working correctly on a site at any time.
13. Intellectual property and your content
We and our licensors own the Service, including its software, design and the AutoApply name and logo. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the extension for your own job search under these Terms.
Your content — your profile, files, answers and the output generated for you — remains yours. You give us a limited licence to process the content you send to our servers only as needed to provide the Service (for example, forwarding a request to the provider configured by AutoApply for Pro (currently Anthropic) to generate a result). We do not use your content to train AI models.
If you send us feedback or suggestions, we may use them without any obligation to you.
14. Privacy
Our Privacy Policy explains what data the Service processes, where it is stored and your rights. Your profile and files are stored in your browser; when you choose an AI feature, some content is sent to your AI provider as described in that policy. We do not sell your data.
15. Changes and availability
We continuously improve AutoApply; features may be added, changed or removed, and the extension updates automatically through the Chrome Web Store. We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. If we discontinue AutoApply Pro, we will give you reasonable notice and refund any prepaid, unused period pro rata.
16. Suspension and termination
You can stop using the Service at any time by removing the extension and, if you have one, deleting your account. We may suspend or terminate your account or access to Pro if you materially breach these Terms (in particular section 6), if the law requires it, or to prevent harm to others or to the Service. Where reasonable, we will notify you first and give you a chance to fix the problem. If we terminate your subscription without cause, we will refund any prepaid, unused period pro rata. Provisions that by their nature should survive termination — including sections 13 and 17 to 22 — survive.
17. Disclaimers
To the extent permitted by law, the Service is provided “as is” and “as available”, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will fill every form correctly, work on every website or produce accurate AI output; you are responsible for checking what you submit. Some jurisdictions do not allow these exclusions, and your statutory rights as a consumer are not affected.
18. Limitation of liability
To the extent permitted by law:
we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, job opportunities or goodwill;
we are not liable for the content of applications you submit, decisions made by employers, or the acts of third-party websites and services;
our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and USD 50.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law. If you are a consumer in the EU or UK, we are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
19. Indemnity
If you use the Service for business purposes rather than as a consumer, you will indemnify us against third-party claims, losses and reasonable costs arising from your breach of these Terms or from applications you submit using the Service.
20. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-laws rules, and the state and federal courts located in Delaware have jurisdiction. If you are a consumer, you also benefit from the mandatory provisions of the law of your country of residence and may bring proceedings in the courts of your place of residence. Consumers in Türkiye may also apply to consumer arbitration committees (Tüketici Hakem Heyetleri) or consumer courts within the limits set each year. Please contact us first — most problems can be solved by email.
21. Changes to these terms
We may update these Terms. For material changes we will give at least 30 calendar days’ notice on this website before they take effect, unless a shorter period is required or permitted by law. If you keep using the Service after the effective date, the updated Terms apply; if you do not agree, stop using the Service and cancel your subscription before that date. For an active Pro subscription, changes apply from your next billing period unless they are required by law.
22. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remain in effect. Failing to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets, with notice to you. We are not liable for delays caused by events beyond our reasonable control. These Terms are provided in English and Turkish. If the versions conflict, the Turkish version prevails for users in Türkiye and the English version prevails for users elsewhere, except where mandatory law provides otherwise.

2. AutoApply nedir, ne değildir
AutoApply, oluşturduğunuz profili kullanarak web sitelerindeki iş başvuru formlarını doldurmanıza yardımcı olur ve YZ’yi açarsanız cevap, ön yazı ve analiz taslakları hazırlar. Alanları doldurur ve dosyaları tarayıcınızda ekler. Başvuruları göndermez. Neyin, ne zaman ve kime gönderileceğine siz karar verirsiniz.
AutoApply bir yazılım aracıdır. İşe alım uzmanı, özel istihdam bürosu ya da kariyer, hukuk, göç veya finans danışmanı değildir; mülakat, iş teklifi veya başka herhangi bir sonucu garanti etmez.
3. Kullanım şartları
Hizmeti kullanmak için en az 16 yaşında olmalısınız. AutoApply Pro satın almak için ülkenizde bağlayıcı bir sözleşme yapabilecek yaşta olmalı (veya veli ya da vasinizin iznini almış olmalısınız). Hizmet kendi iş arayışınız için tasarlanmıştır. Başka birine yardım etmek için kullanıyorsanız — örneğin kariyer koçu olarak — o kişinin yetkilendirmesine sahip olmalısınız ve gönderilen içerikten siz sorumlu olmaya devam edersiniz.
4. Hesabınız
Hesap yalnızca AutoApply Pro için gereklidir. Google hesabınızla giriş yaparsınız. E-posta ve Google hesabınıza erişimi güvende tutun; hesabınız üzerinden yapılan işlemlerden siz sorumlusunuz. Hesaplar kişiseldir — her hesap tek bir kişiye aittir. Yetkisiz kullanımdan şüphelenirseniz derhâl omerdogan0@gmail.com adresine bildirin.
5. Başvuru yaparken sorumluluklarınız
Her başvuruyu siz kontrol edersiniz. Göndermeden önce AutoApply’in doldurduğu her alanı, seçtiği her seçeneği, eklediği her dosyayı ve YZ ile hazırlanan her cevabı kontrol edin. Gönderdiğiniz her başvurunun doğruluğundan, gerçeğe uygunluğundan ve eksiksizliğinden yalnızca siz sorumlusunuz.
Doğruyu söyleyin. Kimliğinizi, niteliklerinizi, deneyiminizi, çalışma izninizi veya başka herhangi bir bilgiyi yanlış beyan etmeyin. Bazı formlar beyanlar, onay kutuları veya hukuki taahhütler içerir; AutoApply bunları profilinize göre doldurabilir, ancak her birini kendiniz okuyup onaylamalısınız.
Her sitenin kurallarına uyun. Kullandığınız her iş ilanı sitesinin, işveren web sitesinin ve aday takip sisteminin kullanım koşullarına uymanız gerekir. Bazı siteler otomatik araçları veya tarayıcı eklentilerini kısıtlar; bunu kontrol etmek ve izin verilmeyen yerlerde AutoApply’i kullanmamak sizin sorumluluğunuzdadır.

6. Kabul edilebilir kullanım
AutoApply, sizin aktif kontrolünüz altında her seferinde tek bir başvuru için tasarlanmıştır. Şunları yapmamalısınız:
AutoApply’i otomatik, toplu veya seri başvuru göndermek ya da işverenlere veya iş sitelerine yük oluşturacak şekilde gelişigüzel başvuru yapmak için kullanmak;
AutoApply’i bot, betik, makro veya başka otomasyonlarla çalıştırmak ya da hiçbir insanın kontrol etmediği formları göndermek için kullanmak;
başka bir kişi adına onun yetkisi olmadan başvuru yapmak veya herhangi birinin kimliğine bürünmek;
yanlış, yanıltıcı, intihal veya hukuka aykırı içerik ya da başkalarının haklarını ihlal eden içerik göndermek;
AutoApply’i web sitelerinden veri kazımak veya toplamak ya da herhangi bir sitenin CAPTCHA, hız sınırı, erişim denetimi veya diğer korumalarını aşmak için kullanmak;
sunucularımıza resmî eklenti dışında erişmek; Hizmeti veya API’sini tersine mühendislikle çözümlemek, kaynak koda dönüştürmek veya işleyişine müdahale etmek (kanunun açıkça izin verdiği durumlar hariç); güvenliğini yoklamak, taramak veya ihlal etmek;
YZ kredi sınırlarını aşmaya çalışmak, ek deneme kredisi almak için birden fazla hesap açmak, hesabınızı paylaşmak veya yeniden satmak ya da Pro özelliklerini başkalarına sunmak;
hukuka aykırı, taciz edici veya ayrımcı ya da AutoApply Pro için şu anda yapılandırılmış Anthropic sağlayıcısının veya kendi YZ sağlayıcınızın (BYOK için) kullanım politikalarını ihlal eden içerik üretmek;
Hizmeti iş, ayrımcılık karşıtı, ihracat kontrolü ve yaptırım mevzuatı dahil yürürlükteki mevzuata aykırı şekilde kullanmak.
7. YZ özellikleri ve çıktıları
YZ özellikleri isteğe bağlıdır. YZ çıktıları profilinizden, formdan ve iş ilanından otomatik olarak üretilir. Hatalı, eksik, güncelliğini yitirmiş veya genel geçer olabilir ve hakkınızda doğru olmayan ifadeler içerebilir.
YZ çıktılarını kullanmadan önce kontrol etmeli, düzenlemeli ve doğrulamalısınız. Sahip olmadığınız deneyim, yetenek veya nitelikleri asla beyan etmeyin.
İşe uygunluk puanları, eşleşme puanları ve iş önerileri size kolaylık sağlamak amacıyla sunulan tahminlerdir. Profesyonel kariyer, hukuk, göç veya finans tavsiyesi değildir. İş ilanlarındaki bilgilerin doğru olduğunu veya pozisyonun hâlâ açık olduğunu garanti etmeyiz.
Bazı işverenler başvurularda YZ kullanımına ilişkin kurallar koyar. Bunlara uyun.
Sizinle aramızda, sizin için üretilen YZ çıktılarını, hukukun sahiplik tanıdığı ölçüde, başvurularınızda kullanma hakkı size aittir. Benzer çıktılar başka kullanıcılar için de üretilebilir.
İş eşleşmelerinde gösterilen ilanlar üçüncü taraf kaynaklardan gelir. İşverenleri onaylamayız veya denetlemeyiz.
8. Kendi API anahtarınız (BYOK)
Kendi OpenAI, Anthropic veya Google Gemini API anahtarınızı (ya da OpenAI uyumlu bir uç noktayı) bağlayabilirsiniz. Bu durumda istekler tarayıcınızdan doğrudan o sağlayıcıya gider ve kullanımınız, kullanım politikaları ve ücretleri dahil olmak üzere o sağlayıcıyla yaptığınız sözleşmeye tabidir. Anahtarınızla oluşan tüm ücretlerden ve anahtarın güvenliğinden siz sorumlusunuz; ifşa olduğunu düşünüyorsanız anahtarı sağlayıcı nezdinde iptal edin. Anahtarınızı hiçbir zaman almayız ve sağlayıcının erişilebilirliğinden, değişikliklerinden veya ücretlerinden sorumlu değiliz.
9. AutoApply Pro aboneliği
Faturalama. Pro, ödeme hizmeti sağlayıcımız Stripe aracılığıyla, ödeme sayfasında gösterilen fiyattan aylık veya yıllık olarak peşin faturalanan ücretli bir aboneliktir. Bulunduğunuz yere göre fiyatlara vergiler dahil olabilir veya olmayabilir; toplam tutar ödeme yapmadan önce gösterilir.
Otomatik yenileme. Aboneliğiniz siz iptal edene kadar her fatura döneminin sonunda o tarihte geçerli olan fiyattan otomatik olarak yenilenir. Her yenileme için Stripe’ın ödeme yönteminizden tahsilat yapmasına izin verirsiniz.
YZ kredileri. Pro, aylık bir YZ kredisi hakkı içerir. Farklı YZ işlemleri farklı miktarda kredi kullanır ve bakiyeniz eklentide gösterilir. Kullanılmayan krediler sonraki aya devretmez ve nakdî değeri yoktur.
Fiyat değişiklikleri. Bir fiyat değişikliği aboneliğinize uygulanmadan en az 30 takvim günü önce bu web sitesinde duyuru yaparız. Kabul etmiyorsanız yeni fiyat yürürlüğe girmeden iptal edebilirsiniz.
Başarısız ödemeler. Bir ödeme başarısız olursa Stripe tahsilatı yeniden deneyebilir; ödeme gerçekleşene kadar Pro özelliklerini askıya alabiliriz.
10. İptal ve iade
İstediğiniz zaman iptal edin: AutoApply ayarları → AI ve plan → Ödemeyi yönet adımlarıyla Stripe müşteri portalını açın. İptal, gelecekteki yenilemeleri durdurur; Pro, ödemesini yaptığınız dönemin sonuna kadar etkin kalır.
İadeler. Ödemeler; kısmen kullanılmış dönemler ve kullanılmayan YZ kredileri dahil, yürürlükteki mevzuatın iadeyi zorunlu kıldığı durumlar (örneğin ülkenizdeki tüketicilere tanınan yasal cayma hakkı) dışında iade edilmez. İptal ettiğinizde sonraki yenilemeler durur; Pro, ödediğiniz dönemin sonuna kadar kullanılabilir.
Yasal haklarınız. Bu bölüm; 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ilgili yönetmelikler ile AB, Birleşik Krallık veya diğer yürürlükteki mevzuattan doğan, cayma hakkı dahil tüketici haklarınıza ek olarak sunulur ve bu hakları sınırlamaz. İade talebinizi iletmek veya cayma hakkınızı kullanmak için hesabınızda kayıtlı e-posta adresinden omerdogan0@gmail.com adresine yazın.
Hesabınızı silmek aboneliğinizi iptal eder ve Pro erişimini hemen sonlandırır. Kalan süre, bu bölüm veya mevzuat uyarınca bir iade söz konusu olmadıkça iade edilmez.
Bir ödeme sorununuz varsa ters ibraz (chargeback) başlatmadan önce lütfen bizimle iletişime geçin; genellikle daha hızlı çözebiliriz.
11. Deneme kredileri ve adil kullanım
Yeni hesaplara giriş yaptıktan sonra tek seferlik ücretsiz YZ kredisi tanımlanabilir. Deneme kredileri kişi başına bir kez verilir, nakdî değeri yoktur ve yeni hesaplar için her zaman değiştirilebilir veya kaldırılabilir. Hizmetin herkes için güvenilir kalması için makul hız sınırları uygulayabilir ve kötüye kullanımla elde edilen kredileri geri alabiliriz.
İlk kez aylık abone olan uygun hesaplar Stripe Checkout üzerinden 7 günlük AutoApply Pro denemesi başlatabilir. Ödeme kartı gerekir. Ödemeyi yönet bölümünden önceden iptal etmezsen, deneme sonunda ödeme sayfası açılmadan önce gösterilen aylık fiyat tahsil edilir. Önceki aboneliği olan hesaplar yeniden deneme başlatamaz. Yıllık plan bu denemeyi içermez. Yalnızca giriş yapmak veya ödeme sayfasını açmak Pro’yu etkinleştirmez; abonelik doğrulanmalıdır. Deneme kullanımı gösterilen AI kredi kotasına tabidir.
12. Üçüncü taraf siteler ve hizmetler
AutoApply, başkaları tarafından işletilen web sitelerinde — işverenler, aday takip sistemleri ve iş ilanı platformları — çalışır ve Stripe, Anthropic, OpenAI, Supabase ve Google gibi üçüncü taraf hizmetlere dayanır. Bunların hiçbiriyle bağlantılı değiliz ve hiçbiri tarafından onaylanmadık; adları ve markaları sahiplerine aittir. İçeriklerinden, erişilebilirliklerinden, koşullarından veya başvurularınızı ve verilerinizi nasıl işlediklerinden sorumlu değiliz. Web siteleri formlarını haber vermeksizin değiştirir; bu nedenle otomatik doldurma bir sitede her an doğru çalışmayı bırakabilir.
13. Fikrî mülkiyet ve içeriğiniz
Yazılımı, tasarımı ve AutoApply adı ile logosu dahil Hizmetin sahibi biz ve lisans verenlerimiziz. Size, eklentiyi bu Koşullar çerçevesinde kendi iş arayışınız için yükleyip kullanmanız amacıyla kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veririz.
İçeriğiniz — profiliniz, dosyalarınız, cevaplarınız ve sizin için üretilen çıktılar — size ait olmaya devam eder. Sunucularımıza gönderdiğiniz içeriği yalnızca Hizmeti sağlamak için gerektiği ölçüde (örneğin bir sonucu üretmek üzere isteği AutoApply Pro için yapılandırılmış sağlayıcıya (şu anda Anthropic) iletmek) işlememiz için bize sınırlı bir lisans verirsiniz. İçeriğinizi YZ modellerini eğitmek için kullanmayız.
Bize geri bildirim veya öneri gönderirseniz, bunları size karşı herhangi bir yükümlülüğümüz olmaksızın kullanabiliriz.
14. Gizlilik
Gizlilik Politikamız; Hizmetin hangi verileri işlediğini, bunların nerede saklandığını ve haklarınızı açıklar. Profiliniz ve dosyalarınız tarayıcınızda saklanır; bir YZ özelliğini seçtiğinizde bazı içerikler, politikada açıklandığı şekilde YZ sağlayıcınıza gönderilir. Verilerinizi satmayız.
15. Değişiklikler ve erişilebilirlik
AutoApply’i sürekli geliştiririz; özellikler eklenebilir, değiştirilebilir veya kaldırılabilir ve eklenti Chrome Web Mağazası üzerinden otomatik olarak güncellenir. Yüksek erişilebilirlik hedefleriz ancak Hizmetin kesintisiz veya hatasız olacağını garanti etmeyiz. AutoApply Pro’yu sonlandırırsak sizi makul bir süre önceden bilgilendirir ve peşin ödenmiş, kullanılmamış dönemi kıst esasına göre iade ederiz.
16. Askıya alma ve fesih
Eklentiyi kaldırarak ve varsa hesabınızı silerek Hizmeti istediğiniz zaman kullanmayı bırakabilirsiniz. Bu Koşulları (özellikle 6. bölümü) esaslı şekilde ihlal etmeniz, mevzuatın gerektirmesi veya başkalarına ya da Hizmete zarar gelmesini önlemek gerekmesi hâlinde hesabınızı veya Pro erişiminizi askıya alabilir ya da sonlandırabiliriz. Makul olduğu durumlarda sizi önceden bilgilendirir ve sorunu gidermeniz için fırsat tanırız. Aboneliğinizi haklı bir sebep olmaksızın sonlandırırsak peşin ödenmiş, kullanılmamış dönemi kıst esasına göre iade ederiz. Niteliği gereği fesihten sonra da geçerli olması gereken hükümler — 13. ve 17–22. bölümler dahil — geçerliliğini korur.
17. Sorumluluk reddi
Mevzuatın izin verdiği ölçüde Hizmet “olduğu gibi” ve “mevcut olduğu şekliyle” sunulur; ticari elverişlilik, belirli bir amaca uygunluk ve hak ihlali olmaması dahil tüm zımni garantileri reddederiz. Hizmetin her formu doğru dolduracağını, her web sitesinde çalışacağını veya doğru YZ çıktısı üreteceğini garanti etmeyiz; gönderdiklerinizi kontrol etmek sizin sorumluluğunuzdadır. Bazı hukuk düzenleri bu istisnalara izin vermez; tüketici olarak yasal haklarınız saklıdır.
18. Sorumluluğun sınırlandırılması
Mevzuatın izin verdiği ölçüde:
dolaylı, arızi, özel, sonuç olarak doğan veya cezai zararlardan ya da kâr, gelir, veri, iş fırsatı veya itibar kaybından sorumlu değiliz;
gönderdiğiniz başvuruların içeriğinden, işverenlerin verdiği kararlardan veya üçüncü taraf web sitelerinin ve hizmetlerin eylemlerinden sorumlu değiliz;
Hizmetle ilgili tüm taleplere ilişkin toplam sorumluluğumuz, talebe yol açan olaydan önceki 12 ayda bize ödediğiniz tutar ile 50 USD tutarından hangisi yüksekse onunla sınırlıdır.
Bu Koşulların hiçbir hükmü; ihmalden kaynaklanan ölüm veya bedensel zarar, hile, ağır kusur veya kast hâllerindeki sorumluluğu ya da kanunen sınırlandırılamayan veya kaldırılamayan başka herhangi bir sorumluluğu (6098 sayılı Türk Borçlar Kanunu’nun 115. maddesi dahil) sınırlamaz. AB veya Birleşik Krallık’ta tüketiciyseniz, bu Koşulları ihlal etmemizden veya makul özen ve beceriyi göstermememizden kaynaklanan öngörülebilir kayıp ve zararlardan sorumluyuz.
19. Tazmin
Hizmeti tüketici olarak değil ticari amaçlarla kullanıyorsanız, bu Koşulları ihlal etmenizden veya Hizmeti kullanarak gönderdiğiniz başvurulardan doğan üçüncü kişi taleplerine, kayıplara ve makul masraflara karşı bizi tazmin edersiniz.
20. Uygulanacak hukuk ve uyuşmazlıklar
Bu Koşullar, kanunlar ihtilafı kuralları hariç olmak üzere ABD Delaware Eyaleti hukukuna tabidir ve Delaware’deki eyalet ve federal mahkemeler yetkilidir. Tüketiciyseniz yerleşim yerinizin hukukunun emredici hükümlerinden de yararlanırsınız ve yerleşim yerinizdeki mahkemelerde dava açabilirsiniz. Türkiye’deki tüketiciler, her yıl belirlenen parasal sınırlar dahilinde Tüketici Hakem Heyetlerine veya Tüketici Mahkemelerine de başvurabilir. Lütfen önce bizimle iletişime geçin — sorunların çoğu e-postayla çözülebilir.
21. Koşullardaki değişiklikler
Bu Koşulları güncelleyebiliriz. Önemli değişiklikleri, kanunların daha kısa bir süreye izin verdiği veya bunu zorunlu kıldığı hâller dışında, yürürlüğe girmeden en az 30 takvim günü önce bu web sitesinde duyururuz. Yürürlük tarihinden sonra Hizmeti kullanmaya devam ederseniz güncellenmiş Koşullar uygulanır; kabul etmiyorsanız bu tarihten önce Hizmeti kullanmayı bırakın ve aboneliğinizi iptal edin. Etkin bir Pro aboneliği için değişiklikler, mevzuat gereği zorunlu olmadıkça bir sonraki fatura döneminizden itibaren uygulanır.
22. Genel hükümler
Bu Koşullar ve Gizlilik Politikası, Hizmet konusunda sizinle aramızdaki sözleşmenin tamamını oluşturur. Herhangi bir hükmün uygulanamaz bulunması diğer hükümlerin geçerliliğini etkilemez. Bir hükmün uygulanmaması o hükümden feragat anlamına gelmez. Bu Koşullardan doğan haklarınızı onayımız olmadan devredemezsiniz; biz ise haklarımızı bir birleşme, devralma veya varlık satışı kapsamında size bildirerek devredebiliriz. Makul kontrolümüz dışındaki olaylardan kaynaklanan gecikmelerden sorumlu değiliz. Bu Koşullar İngilizce ve Türkçe olarak sunulmuştur. Metinler arasında çelişki olması hâlinde, emredici mevzuat hükümleri saklı kalmak üzere, Türkiye’deki kullanıcılar için Türkçe metin; diğer ülkelerdeki kullanıcılar için İngilizce metin esas alınır.
